Maharashtra Factories (Amendment) Rules, 2015.

NOTIFICATION

THE FACTORIES ACT, 1948

No. FAC.2013/R.R.169/C.R.204/Lab-4.- In exercise of the powers conferred by Sections 112 and 115 of the Factories Act, 1948 (63 of 1948), in its application to the State of Maharashtra (hereinafter referred to as "the said Act") read with clause (3) of Section 23 of the General Clauses Act, 1897 (10 of 1897) and of all other powers enabling it in that behalf, the Government of Maharashtra hereby amends the Maharashtra Factories Rules, 1963, the same having been previously published as required by sub-section (1) of Section 115 of the said Act, as follows, namely:-

1. These Rules may be called The Maharashtra Factories (Amendment) Rules, 2015.

2. In Rule 5, of the Maharashtra Factories Rules, 1963 (hereinafter referred to as "the principal Rules"),-

(a) in sub-rule (2), for Schedule "8" appended to sub-rule (2), it, the following shall be substituted, namely:-

(b) Schedule ‘C’ shall be deleted.

3. After sub-rule (3) of rule 5 the following sub-rule (4) shall be inserted:-

(4) Where the fees for the grant or renewal of a licence for the year (2016) are paid before the (1st January, 2016) and the fees so paid are less than the fees payable in accordance with rates prescribed in the "Schedule B" in sub-rule (2), then the licensee shall pay the difference on or before the (31st day of October, 2016). If the licensee fails to pay the difference on or before the (31st day of October, 2016), he shall be deemed to have paid the fees after the expiry of the due date and an additional fee of 25 per cent of the difference shall be payable by him.

In Rule 11 of the principal Rules,-

(a) in sub-rule (1), for the words "rupees five" the words "rupees five hundred" shall be substituted;

(b)in sub-rule (2), for the words "rupees five" the words "rupees five hundred" shall be substituted.

5. In Rule 13 of the principal Rules, in sub-rule (2), for the word and figure "Form 3" the word and figure "Form 2" shall be substituted.

6. In Rule 17 of the principal Rules, to clause (a), after the word "to photograph" the words "or to video record" shall be inserted.

7. In Rule 45 of the principal Rules, to clause (a), the following proviso shall be added, namely-
"Provided that where the number of females employed exceeds 30, it shall be sufficient if there is one latrine for every 10 femalesupto the first 30 and one for every 30 females thereafter".

8. In Rule 64 of the principal Rules, in sub-rule (1), after the word "for the first time therein" the word "and thereafter once in a period of twelve months' shall be inserted.

9. In Rule 70 of the principal Rules, in sub-rule (7), in proviso to clause (a), for the words, figures and letter "flash point of 20°C or less" the words, figures and letter "flash point of 23°C or less" shall be substituted.

10. In Rule 73 X of the principal Rules, after sub-rule (2), the following shall be added, namely:-
"(3) Within one month of the provision of the Ambulance Van, the Occupier of the factory shall furnish its particulars to the Chief Inspector".

11. In Rule 78 of the principal Rules, after sub-rule (5), the following shall be added, namely:-

"(6) Within one month from the appointment of a qualified Medical Officer, the occupier of the factory shall furnish to the Chief Inspector, the following particulars, namely:-

(a) Name and address of the qualified Medical Officer,

(b) Qualifications,

(c) Experience, if any, and

(d) Rule, sub-rule, clause or sub-clause of these rules under which such Medical Officer is appointed".

12. In Rule 114 of the principal Rules, in the Schedule XXVI appended thereto, in sub-clause (b) of clause 12, after the words, "St. John's Ambulance Association" the words "or the certificate granted by the first aid training institute recognized by the State Government under sub-section (3) of Section 45 of the Act" shall be inserted.

13. In Rule 115 of the principal Rules, in sub-rule (1) for the words “or telegram” the words, “Electronic mail (mail), Fax or short message service (SMS) by mobile phone”, shall be substituted.
