Factory Registration/Reneal of Licence in Maharashtra
Need to pay huge concentration when you are going to apply for factory license
Every such application shall be accompanied by relevant physical documents as listed below.
1. Application for Grant of License - Please find the
attached Form
1 under Rule 3 (Revised as on December 2015) for Application for
permission
a.
to construct a new factory,
b.
to extend existing factory or
c.
Take into use any building as a factory.

Application for Registration and Notice of
occupation specified in sections 6 and 7 and for Grant of licence of a factory (also
for renewal) in Triplicate.
2.
Declaration for
Grant of License – Please find the attached – Grant of Licence terms as ‘Jahir Nivedan’
3.
Form 1A- Certificate
of Stability Issued by Chief Inspector under Rule 3A. in case in Mumbai or competent person
- Form 2 - Application for Registration and notice of Occupation specified in Sections 6 and 7 & Rule under 5 & 14.

Affix
Court Fee Stamp of: र 10
·
Application
in triplicate
·
In
the case of a factory, where under the provisions of sub-section (1) and (2) of
section 100 a person has been nominated as the occupier, Information required
in item 8 should be supplied only in respect of that person.
·
In the case of a factory where a Managing Agent
or Agents have been appointed as occupiers information required in item 8
should be supplied only in respect of that person or person.
·
Registration
of the Factory for a period not exceeding 10 years

Form 3 rule 5, 8 and 11- Application for
licence/renewal of licence of a factory a declaration Form, about date of commencement of manufacturing
process in prescribed format – (refer to attachment MAFRF3)
a.
Proof
for Ownership of Premises (Owned/Rented/Leased etc.)
( Note In case of owned-7/12 extract, tax receipt, In case of factory located in M.I.D.C.- a allotment letter from M.I.D.C., In case of Rented/Leased-a lease deed)

the fact should be communicated to the chief inspector immediately

A
Copy of Letter of Approval of Plan by DISH - Plans in duplicate drawn to scale
showing -
·
the site of the
factory and immediate surrounding including adjacent buildings and other structures,
roads, drains etc.;
·
the plan,
elevation and necessary cross-section of the various buildings,
·
Relevant details
relating to natural lighting, ventilation and means of escape in case of fire.
·
The plans shall
also clearly indicate the position of the plant and machinery, aisles and
passage ways
8.
Challan/Fee
receipt, Original copy of Challan of license fees paid + oneself certified
xerox copy of challan
a.
The payment
to be made via cheque/payorder in Mumbai City in favor of "Director,
Industrial Safety & Health"
(DISH). In rest of the zones, the payment to be deposited in
State Bank of India via Treasury Challan in favor of State Bank of India on
Account of Joint Director, Industrial Safety & Health.

Note – In case of
Renewal - Every factory having valid licence for 2013 and onward,
must pay their difference fee due to increase for 2013 and onward period
before Oct, 2013 to the department without any late fee.
Late fee is applicable on 5% base from November, 13 onward for every month with maximum late fee of 25% for the current and next year only. Late fee not applicable for advance renewal of future period.

9.
A- In Case of Public Limited/Private
Limited Company:
- A certified copy of MOA, A copy of List of Directors with residential address certified by company secretary.
- A copy of Board Resolution nominating one of the Director as an Occupier certified by the Company Secretary.
B- In case of Partnership Firm.
- Partnership Deed with duly Registered from Register of Firms.
- NOC for other partner for accord one partner an Occupier
- In case Central/State Government Organization, an Order issued by an appropriate authority/G.R. with respect to the nomination of an Occupier.
Application will be processed as per the provisions of the Rule 6 of the Maharashtra Factories Rules 1963. Notification to applicant will be sent on applicant’s email or SMS. Hence it would be nice to provide email address and mobile number to the department.
