Contractual employees are entitled to same leave benefits as Regular Employees

The Delhi High Court in Sonia Gandhi v. Government of NCT of Delhi, held that contract appointed employees working in public sector undertakings are entitled to leave of all kinds at par with regular employees, including maternity and sick leave. In that case, the court was concerned with contractual employees working in various hospitals established by the Government of NCT of Delhi and the Municipal Corporation of Delhi, wherein there was large scale contract appointments. The court also highlighted that good governance would require the Government to ensure regular posts being sanctioned commensurate to the public need as it ill serves the interest of the society if requisite number of public posts are not sanctioned. In that case, the court also sanctioned equal wages at part with regular employees, and directed the government to frame a one-time regularisation scheme, to absorb the large number of contract labour working in government hospitals.

The Payment of Bonus (Amendment) Bill, 2015

The Payment of Bonus (Amendment) Bill, 2015   Is only approved by Union Cabinet.  Now the bill will be tabled in Parliament for approval in its  winter session. The Cabinet on Wednesday decided to double the wage ceiling for calculating bonus to Rs 7,000 per month for factory workers and establishments with 20 or more workers. The Payment of Bonus (Amendment) Bill, 2015 to enhance the monthly bonus calculation ceiling to Rs 7,000 per month from existing Rs 3,500 was approved by Union Cabinet here The amendment bill will be made effective from April 1, 2015. Period of Limitation for appeal under section 45AA of ESI Act

Under this provisions an employer, who is not satisfied with the order u/s 45A, can prefer an appeal before the Appellate Authority within 60 Days of the date of such order. EPFO Further Streamlines On Line Registration of Establishments (OLRE) Under the guidelines issued by the Central Provident Fund Organization with regard to online registration of establishment, it was stated that the Central Provident Fund Organization has clarified that the officers cannot insist for personal presence of the employer and further cannot insist for production of past records. The following internal circular dated: 28.9.2015 issued by the Central Provident Fund Organization to the field functionary to follow further guidelines with regard to the online registration of establishment. The Provident Fund Organization further streamlines the procedure for on line registration. Remittance of PF contribution electronically through Internet Banking The Central Government by Notification dated 5.5.2015 had made remittance of PF Contributions electronically through internet Banking mandatory effective from 5.5.2015. The Central Provident Fund Commissioner has now allowed the Employers to remit less than Rs.1,00,000/- Statutory dues by physical mode (Bank Draft / Cheque / Bankerís Cheque) for only a transitory period upto 31.12.2015. It shall be compulsory to make payment electronically with effect from 1.1.2016 through internet Banking only.
